The three major operators announced the "Implementation Rules for Number Portability Service"

On November 10, the Ministry of Industry and Information Technology issued the "Regulations on the Management of Number Portability Services". According to the national promotion schedule of "number portability", various telecom companies and the China Academy of Information and Communications Technology have completed the construction and transformation of the national "number portability" system, and the relevant systems have been put into trial operation since November 10.

Today, the three major operators have all announced the "Implementation Rules for Number Portability Services" on their official websites. The "Implementation Rules" were formulated based on the relevant management regulations of the Ministry of Industry and Information Technology and in combination with the actual situation of the three major operators. They provide a detailed introduction to the service principles, service scope, application conditions, required materials, and application procedures for "number portability".

The Implementation Rules show that the numbers that do not provide number portability services at this stage include:

  1. Satellite mobile service number: network number is 1349, 174, etc.;
  2. Mobile communication resale numbers: network numbers such as 170, 171, 162, 165, 167, etc.;
  3. Internet of Things Numbers: Internet of Things-specific network numbers (such as 146, 148, 149, 140-144, 1064, etc.) and other ordinary public mobile communication network numbers used for Internet of Things applications;
  4. Other situations that do not comply with national policy regulations.

The Implementation Rules also explain the division of rights and responsibilities for number portability. Before the network switch is completed, the original mobile phone card of the number porting user can be used normally, and the outgoing party provides telecommunications services to the number porting user. After the network switch is completed, the original mobile phone card of the number porting user becomes invalid, and the telecommunications service relationship between the outgoing party and the number porting user is terminated. At the same time, the new mobile phone card is activated and used, and the incoming party provides telecommunications services to the number porting user. The incoming party shall not provide telecommunications services to the number porting user before the network switch is completed.

The carrier shall sign a telecommunications service agreement with the incoming user on the principle that the incoming user enjoys equal rights under the same conditions as new users of the network.

After the ported user number is cancelled, the ported party shall not continue to use the number and must return the number to the telecommunications business operator that originally used the number within 5 days after the shortest freezing period required by the "Telecommunications Service Specifications".

Attached is China Mobile's "Number Portability Service Implementation Rules" (China Telecom and China Unicom's implementation rules are basically the same as China Mobile's)

In order to strengthen the management of number portability services, protect the legitimate rights and interests of users, and promote the healthy development of the telecommunications industry, these implementation rules are formulated in accordance with the "Number Portability Service Management Regulations" of the Ministry of Industry and Information Technology and in light of China Mobile's actual situation.

1. Service Principles

Guarantee users' right to free choice, continuously improve service mechanisms, strengthen customer service staff training, unify service rules, improve service quality, and provide users with convenient and efficient number portability services.

II. Service Scope

These rules apply to the application, processing and provision of number portability services within the territory of the People's Republic of China (excluding Hong Kong, Macao and Taiwan).

Number portability service refers to a service in which cellular mobile phone users (excluding Internet of Things users) change the basic telecommunications business operator they sign a contract with within the same local telephone network while the user number remains unchanged.

Numbers that do not provide number portability services at this stage include:

  1. Satellite mobile service number: network number is 1349, 174, etc.;
  2. Mobile communication resale numbers: network numbers such as 170, 171, 162, 165, 167, etc.;
  3. Internet of Things Numbers: Internet of Things-specific network numbers (such as 146, 148, 149, 140-144, 1064, etc.) and other ordinary public mobile communication network numbers used for Internet of Things applications;
  4. Other situations that do not comply with national policy regulations.

III. Application conditions for carrying out

The number applying for number portability service must meet the following conditions:

  1. The person has registered his/her real identity information with the original contracted telecommunications business operator (hereinafter referred to as the "porter") to join the network (hereinafter referred to as "real-name network access"). Valid documents for personal real-name network access include resident identity cards, temporary resident identity cards, household registers, mainland travel permits for Hong Kong and Macao residents, residence permits for Hong Kong and Macao residents, mainland travel permits for Taiwan residents, residence permits for Taiwan residents, passports of foreign citizens, permanent residence permits for foreigners, and other valid identity documents prescribed by laws, administrative regulations, and the state. At this stage, government and enterprise customers who have joined the network with unit certificates should transfer the number to a natural person, and then apply for number portability service;
  2. In normal use (not reported lost, shut down, etc.);
  3. Settle all the telecom charges that have been paid with the carrier. If there are any unpaid telecom charges (such as international roaming charges, etc.), the time and method of payment have been agreed upon with the carrier;
  4. There is no agreement with the porter on a time limit for online use, or the time limit for online use has been lifted;
  5. It has been 120 days (calendar days) since the last number portability.

4. Bring in the application materials

When users apply for number portability service at China Mobile, they should provide the following materials:

  1. Valid ID of the number user registered with the porting party (same as the valid ID of the individual real-name network registration);
  2. A valid export authorization code;
  3. The mobile phone SIM card corresponding to the number for which you are applying for porting service;

At this stage, in principle, we do not provide the service of bringing in documents by entrusting others to handle the matter.

5. Application for carrying out and handling process for carrying in

When users apply for the number portability service, they must first check with China Mobile whether their number meets the portability conditions. If the conditions are met, the user applies to China Mobile for a portability authorization code and goes to the proposed telecom operator (hereinafter referred to as the "incoming party") to handle the porting. After the handling is completed, the incoming party will provide the user with a new mobile phone card.

To apply for number portability service, users must first check with the carrier to see if the number meets the portability conditions. If the conditions are met, the user applies to the carrier to obtain the portability authorization code and go to China Mobile to apply for porting. After the application is completed, China Mobile will provide the user with a new mobile phone card.

6. Carry-out service

When China Mobile acts as the portability party, it provides portability condition inquiry service, portability restriction removal service and portability authorization code application service to users of this network.

(I) Carry-out Conditions Query Service

Users can edit a short message "CXXZ#name#ID number" and send it to China Mobile's official customer service short message platform 10086 to check whether the number meets the portability conditions. 10086 will promptly feedback the user's query results. For those who meet the conditions, if there are other services affected by number portability, the user will be informed of the affected services at the same time as the query results are fed back, and the information will be true and accurate. For those who do not meet the conditions, the user will be clearly informed of the reasons for not meeting the conditions, the services affected after number portability, and the consultation channels at one time, and the user will be provided with consultation on how to meet the conditions through customer service telephones and other methods.

(II) Service for lifting restrictions on carry-out

If the conditions of Article 3, Item (4) of these Rules are not met and there are services affected by number portability, users may apply to lift the restrictions on number portability.

For those who cannot remove restrictions online, China Mobile will provide users with the service of removing restrictions in all its own physical business halls in the number's location; for those who do not have its own physical business halls in the county-level area, at least one cooperative business hall will be guaranteed to provide the service of removing restrictions. Users can check the specific list of business halls through China Mobile's online business halls in various provinces (autonomous regions, municipalities directly under the central government) or the 10086 customer service hotline.

For those who do not meet the requirements of Item (4) of Article 3 of these Rules, if the user applies for the service to lift the network period restriction and meets the conditions for lifting, China Mobile will allow the user to port his/her number to another network within 24 hours; for those whose services are affected by number portability, China Mobile will immediately allow the user to port his/her number after the user applies for the service to lift the number portability restriction.

(III) Application service for authorization code for export

Users can apply for a port-out authorization code by editing a short message "SQXZ#name#ID number" and sending it to China Mobile's official customer service short message platform 10086. 10086 will promptly feedback the user's application results. For those who meet the conditions, if there is no service affected by number portability, the port-out authorization code will be provided to the user immediately, and the port-out risk notification will be made. The risk notification must be true, accurate and objective; if there is a service affected by number portability, the user will be informed of the relevant impact and solution in a timely manner, and the port-out authorization code will be provided to the user after confirmation. The port-out authorization code is valid for 1 hour and can be applied again after it expires; during the validity period of the authorization code, the user can only handle payment, recharge, report loss, unblock, reissue and password reset services.

VII. Import Services

When China Mobile is the carrier, it can provide carrier services to users who intend to port to the network during the business hours of various business locations. Business locations include all owned physical business halls in the location where the number is located. Users can call China Mobile's 10086 customer service hotline to inquire about the business hours of the business hall.

1. Implementing the real-name system

Users who apply for porting in will be treated as new users joining the network and will be processed in accordance with the "Regulations on Registration of Real Identity Information of Telephone Users" and other requirements.

(II) Informing of matters needing attention

Regarding matters needing attention regarding number portability, China Mobile Business Hall will clearly inform users through the "Notice to Users (Number Porting Users)", please pay attention:

  1. Due to differences in technology and equipment, users may need to change terminals;
  2. Normal communications may be affected for a short period of time when the user activates the new card and during the network switch;
  3. The user needs to settle the unbilled fees with the porting party when applying for porting service;
  4. The points, credit, VIP level and various benefits enjoyed by the user at the porting party may no longer be used;
  5. Some businesses (services) provided by the carrier and its partners may no longer be available;
  6. Users must promptly inform the service providers of the number-related services in the society of the number portability matters;
  7. Other matters that should be notified.

Please read the "Notice to Users (For Incoming Users)" and sign to confirm after knowing and accepting the above matters needing attention.

8. Number Portability

(I) Division of Powers and Responsibilities

After China Mobile receives notification of successful implementation of the number portability, the network switch is completed. Before the network switch is completed, the original mobile phone card of the number porting user can be used normally, and the outgoing party provides telecommunications services to the number porting user. After the network switch is completed, the original mobile phone card of the number porting user becomes invalid, and the telecommunications service relationship between the outgoing party and the number porting user is terminated. At the same time, the new mobile phone card is activated and used, and the incoming party provides telecommunications services to the number porting user. The incoming party shall not provide telecommunications services to the number porting user before the network switch is completed.

The carrier shall sign a telecommunications service agreement with the incoming user on the principle that the incoming user enjoys equal rights under the same conditions as new users of the network.

(II) Balance and bill processing

After the number portability is completed, the telecommunications service agreement signed between the outbound party and the user and the related services provided will be automatically terminated. The outbound party will handle the outbound user's account balance and provide billing services in accordance with the rules for user deregistration on this network.

(III) Recovery of Fees from the Carrying Party

After the number portability is completed, the outbound party is responsible for notifying the user to settle the telecommunications charges between the outbound party and the outbound party within the agreed period and issuing a telecommunications bill. The user shall pay the fees to the outbound party in accordance with the payment notice. If the fees are not paid within the deadline, the outbound party may collect the relevant telecommunications fees in the manner agreed with the user.

(IV) Handling of network barriers

China Mobile has established a system for handling communication barriers for number portability to ensure the quality of communication services for number portability users. When a user encounters communication barriers, the relevant telecommunications business operators shall cooperate with each other and actively and properly handle the communication barriers for number portability users.

(V) Number return request

After the ported user number is cancelled, the ported party shall not continue to use the number and must return the number to the telecommunications business operator that originally used the number within 5 days after the shortest freezing period required by the "Telecommunications Service Specifications".

IX. Agreement Management

(I) Network access agreement management

The network access agreement signed between China Mobile and its users will state the following matters:

  1. Users have the right to choose the number portability service and apply for it in accordance with these rules;
  2. The time point when the network access agreement of the incoming user takes effect;
  3. During the process of number portability service, necessary user information will be provided to the centralized number portability service management system for comparison to see whether the certificate information registered by the incoming and outgoing parties is consistent.

(II) New Agreement Management

From the date of publication of these rules, any new agreement signed between China Mobile and users with a network term limit will include the responsibilities and methods for users to unilaterally terminate the agreement.

(III) Old Agreement Management

If the agreement with the user that has a limited term of network contract signed by China Mobile and the user before the release of these rules does not include the responsibility and method for the user to unilaterally terminate the agreement, China Mobile will provide it separately in accordance with the principle of fairness and justice. If the user has a dispute over the termination conditions provided by China Mobile, it shall be handled in accordance with the Contract Law, Consumer Rights Protection Law and other relevant national laws and regulations.

10. Supplementary Provisions

If there are any changes in relevant national laws and regulations, government regulations, industry regulations, etc., these rules will be adjusted accordingly.
